La regulación de la biotecnología moderna en la Unión Europea

La evolución de la biotecnología moderna en los últimos decenios ha comportado avances sorprendentes que van más allá de la ingeniería genética y se abren actualmente a nuevos desarrollos en el campo de la biología sintética. Sin embargo, la rápida expansión de estas tecnologías no coincide con el marco jurídico internacional existente, muy fragmentado e incompleto. En la Unión Europea (UE), especialmente, el uso de estas tecnologías ha planteado reservas importantes, que se reflejan en el desarrollo de un marco regulatorio particularmente restrictivo. Este trabajo presenta algunas de las características más significativas del procedimiento de autorización en la UE para la liberación de OMG, un procedimiento centralizado y anclado en el principio de precaución, a la vez que aborda el margen de discrecionalidad de los Estados miembros con respecto a este tipo de cultivos. A partir de ahí se pretende identificar algunas de las cuestiones que suscita el encaje de los nuevos desarrollos biotecnológicos, en particular, de la biología sintética, en el actual marco normativo de la UE.
