The Spanish National Energy Efficiency Fund. Regarding the judgment of the European Union Court of Justice of August 7, 2018

Directive 2012/27/EU on energy efficiency, imposed on States the obligation to achieve efficiency objectives for the year 2020. This norm gave the States several alternatives to achieve the objectives. In this context, Spain created the National Energy Efficiency Fund to collect resources, allocate them to finance the State’s energy efficiency initiatives and comply with European objectives.
This paper analyzes the Fund as a unique mechanism to improve energy efficiency in view of the judgment of the European Union Court of Justice of August 7, 2018, case C-561/16. In this case, some operators in the energy sector questioned the Spanish model because it was based exclusively on the obtaining of economic resources
