This paper tackles the latest reports and documents published in 2018 by MITECO about the application of Law 26/2007, of 23 October, of Environmental Liability, and focuses on two fundamental aspects of the regime: financial guarantees, and the criteria and the procedure for determining significant adverse effects of environmental damage. Moreover, this contribution analyses the judgments handed down by our courts in this matter during the year 2018.
