Abstract

For some years common EU law has accumulated a lot of measures about human rights, but in a scattered way and with different legal denseness. After many efforts, during the French semester, in 2000, it was proclaimed the Charter of Fundamental Rights by European Union. Without prejudice to taking some effects, it was necessary to give it full legal worth. The same thing as it was attempted with the European Constitution although that determination did not work. Now, the Treaty of Lisbon, in process of being ratified, tries to consider the Charter as a constitutional regulation. It is aroused the question about the scope of the Charter in Spain. On the other hand, the Fundamental Law that authorizes the Spanish ratification of the Treaty of Lisbon stirs up interesting problems that must be looked through to be prepared.
