Among the institutions of public law, few are as consequential and as conceptually complex as prescription. It is therefore striking that Law 39/2015 devotes to it only a single provision–one that lacks the clarity and comprehensiveness required to provide both claimants and legal practitioners with a coherent set of rules ensuring the proper functioning of the system. In practice, this role has instead been assumed by case law and advisory bodies, whose doctrinal contributions this study seeks to examine. The aim is twofold: first, to dispel certain myths and contradictions that continue to surround the notion of prescription; and second, to distill interpretative guidelines on issues of particular importance, such as the determination of the dies a quo in categories of damage not expressly regulated by the Law, and the interruption of prescription in cases where an administrative decision is annulled by judicial ruling
