Contractual authorization for private occupation of public domain in France

Private occupations of the public domain correspond to a mode of use of the latter which is contrary to its essence. This observation has a number of consequences for the regime of private occupation permits, which remains marked by precariousness and an atmosphere that is exorbitant in relation to common law. However, the reflection undertaken over the last few years, under the impetus of the doctrine and the Council of State, have produced changes within this regime which now provide rights for the private occupier.
