Circular or in a Loop? The insufficient transformation of waste legislation

Abstract

This paper wants to examine the new law in the context of the circular economy. Preventive policies, non-generation of waste, should be the primary objectives to advance in circularity. Retuning waste legislation so that the actors involved introduce preventive actions and are penalized for those that are not, should be the consequence. To what extent this is achieved in the new legislation is the object of this analysis: contextualizing the provisions of the new waste law based on its contribution to the circular economy and, therefore, to global sustainability.
