Presentation of the principal determinants of the process of institutionalization of habitat banks in Spain. Firstly, the relative legal basis that can be found in the Habitats and the Environmental Liability Directives. Secondly, the political differences generated by the regulation of habitat banks. Thirdly, the doctrinal criticism raised by the shortcomings of such regime. And finally, the failure of the project of regulation of the institution due to the opposition of the environmental movement. In such situation of distrust and longing that brings paralysis to the institution, a reflection on the basis of the aforementioned elements leads us to defend the ex-novo establishment of a complete legal regime of the matter.
