Observations regarding the statutory competence of Castile and León over the Duero

Abstract

The text examines Castilla y León’s authority over the waters of the Duero Basin under the 2007 Statute of Autonomy. The author argues that granting the region legislative-development and executive powers over the Duero waters complies with the Spanish Constitution and does not encroach on state powers. He emphasizes that the Spanish part of the Duero Basin is overwhelmingly linked to Castilla y León, making regional management legally feasible and administratively reasonable, provided that state hydrological planning and Spain’s international obligations toward Portugal are respected.
