Electronic procurement under the spanish LCSP

An analysis and an answer—Is it possible to mandate that bidders submit tenders electronically?

Abstract

In this article, the author analyses different issues about the scope of the Spanish new Contracting Law on regard of eProcurement processes. The author focuses in what can be considered the main stage of the contracting activity, i.e., the electronic tendering process. Among other issues, the author gives his opinion about the key factors leading to success in the electronic procurement of mastermind services. Finally, the author addresses one last important issue: Can electronic tendering be compulsory?. The author’s opinion is positive to this particular regard.
