Some reflections on the criminal law aspects contained in the State Pact against gender violence

The aim of the paper is to analyze the State Pact against gender violence, whose mission is to update the comprehensive protection measures against gender violence that exist since Organic Law 1/2004 as well as to consolidate the consensus that prompted the approval of that law. The paper assesses the measures of criminal nature provided for in the Pact which have been elaborated without taking into consideration the expert opinion of criminal law academics. Therefore, the proposed legal modifications are not always sufficiently substantiated. In some cases, because they lack the necessary systematic to make the Penal Code coherent and consistent with the regulation of gender violence, and in others because they oppose or challenge some principles consolidated in Criminal Law.
