Power, function. A review from transnational and global public law

The pair of concepts «power» and «function» boast a long standing tradition of debate within the European continental legal space, concerning the nature of the administrative activity and its democratic foundations in a rule of law State. The aim of the present essay is to review the current status of this distinction in the context of the new phenomena of Administrative Law, including the transnational and global levels. With this target in mind, we present, on the one hand, a brief critical analysis of the classical conceptions of both concepts; on the other hand, the contrast between this model and what we call «loyal» and «hostile» transnationality. Thirdly, we try to solve this contrast with a proposal of a wider concept, which includes inside both models —still applicable under national law— but that categorizes supranational cases. This proposal has been called «the function of legal-public relevance».
