Organizational legal authority of Public Administrations, ordering of work positions and judicial review

Abstract

The study presented here analyses the organizational legal authority of the Civil Service and its work regarding the organization of its posts. Specifically it deals with the study of organizational legal authority as the discretional legal authority of the Government, whose work directly affects the judicial situation of civil servants. In order to do this it is necessary to analyse the scope of this discretion and how it is controlled by the ordinary judiciary; a control which is coordinated through the general paths of control of administrative discretion.
